DIGITAL PRODUCTS/ WORKSHOP & TRAINING TERMS OF USE 

The following terms and conditions apply to any person registering for a workshop or custom training session with Ariana Jay, LLC. All notifications of cancellations and requests for transfers must be sent via email to hello@mrsarianajay.com

 

Assent & Acceptance

By purchasing and participating in a Course, Coaching, Workshop, Digital Product, Training, or any other service linked to these Terms of Use (from here on: “the services”) you warrant that you’ve read this information and agree to it.

 

Terms

Any materials provided within the term of your service remain the property of Ariana Jay and cannot be shared with any outside party. You are free to use them within your personal business and for their intended purpose, but if you are found to be sharing these materials, I reserve the right to terminate your access to the materials and potentially even the service. Basically, be a good person, friends! I’ve put a lot of work into the materials and information I provide you.

•           I can provide you the information, but you are solely responsible for implementing any aspect of the relevant training within your life and business.

•           I am not liable for any result or non-result or any consequences that come from your participation in this service.

•           This service does not provide any medical, legal, or therapeutic advice. 

 

Account Creation

In order to use the Service, you may be required to provide information about yourself including your name, email address, username and password, and other personal information. You agree that any registration information you give to Ariana Jay LLC will always be accurate, correct, and up to date. Also, as much as I know you love dressing up for Halloween, you’re not allowed to impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorized purpose. You must not, in the use of the service, violate any laws in your jurisdiction.

 

Cancellations and Refunds

•           In-person & Digital Workshops – If you are unable to attend your booked workshop, you are able to receive a full refund (minus a $50 admin fee) if you give at least 28 days notice before the date of your booked workshop. Otherwise, all workshop bookings are non-refundable. 

•           Online Courses or Coaching (including digital products) – Due to the digital nature of my online courses and programs I don’t offer refunds.

•           Custom Training (i.e. Intro Coaching Session) – 1-on-1 custom sessions are also non-refundable as I begin preparing for our session/s from the moment you book in.

  • Coaching Program - Due to the nature that all material is accessible at the time of purchase, and coaching agreement is signed, refunds/charge backs are not offered.

  • Payment Security and Chargebacks. To the extent that Client provides Company with credit/debit

    card(s) information for payment on Client’s account, Company shall be authorized to charge Client’s

    card(s) or account(s) for any unpaid charges on the dates set forth in this Agreement.

    (a) Client may cancel participation in the Course/Program at any time for any reason by providing written notice to Company. Upon cancellation, access to the Program and Services will be terminated. However, cancellation of participation and/or this Agreement by Client will not extinguish the Client’s obligation to pay the full program fee as outlined in Section 2(a). Client will remain obligated to pay all remaining unpaid program fees in full.

     

    (b) In the event that Client engages in abusive or unprofessional behavior in the Course/Program, towards representatives of Company or other Program members, Company reserves the right to cancel Client’s membership and terminate access to the Services, without notice. No refund will be provided in the event that this takes place. Client will remain obligated to pay all remaining unpaid program fees in full.


    (c) Company may decide to terminate the coaching relationship at any time. In the event that Company decides to do so, Company shall release Client from any further financial obligation under the Terms/Conditions and will provide a prorated refund based on time remaining in the Program, if Client paid in full. This does not include the circumstances described in Section 5(b).

     

    (d) Client’s failure to effectively participate in the Course/Program is not grounds for a refund.


  • If Client selects the multiple payment/installment plan to make payments to Company, Company

    shall be authorized to make all charges at the time they are due and not require separate

    authorization in order to do so. Client agrees to not dispute any charges at any time. In the event

    that Client inadvertently disputes a charge made to the account, Client agrees to immediately

    cancel/withdraw such a dispute. Client agrees to not cancel the credit/debit card that is provided as

    security without Company’s prior written consent. Client is responsible for any fees, including

Payment Plans

By signing up to a service using a payment plan, you commit to fulfilling all payment obligations as originally agreed upon at time of sign up. It is your responsibility to ensure the correct payment method is always linked to your account. Ariana Jay reserves the right to pursue legal action should you fail to keep up with the terms of your payment plan.

 

Transfers to a Future Exact Offering

Transfers are available at the sole discretion of Ariana Jay and are subject to another exact offering being available. Notice must be given at least 48 business hours before the start-time of the Course or Workshop. Please request a Transfer by emailing hello@wholecomedia.com. Only one transfer is allowed, and a refund option is not offered on an already transferred service. Transfers are not allowed on digital products.

 

Substitutions

Substitutions (putting another person in your place) are allowed when given a minimum of 24 hours notice before the start-time of the service. They are not allowed for digital products. You are responsible for organizing all details of the substitution, and both you and the person substituted for you must email me at hello@mrsarianajay.com.

 

Non-Attendance 

If you do not attend a service, there will be no refunds or transfers. All efforts will be made to remind you of your start date, but it is ultimately your responsibility to remember the dates, times, and location.

 

Recording & Photos

All services are subject to being recorded and/or have photos taken at in-person events. All of this content is subject to being used however I determine necessary, inclusive of being shared in my marketing efforts. By attending these events, you release your rights to these photos and video content, and grant Ariana Jay royalty-free, non-exclusive, worldwide license to copy, display, use, broadcast, transmit, and make derivative works of this content. 

Of course, I also understand that there may be personal information shared within some of these sessions. All efforts will be made to protect your privacy in any content chosen to be used or shared. I want you to feel comfortable being you, my friend.

 

Bonuses

Any bonuses for limited-time offers must be used within 1 month of original purchase or within the timeframe of the offer (i.e. if you have signed up for a 3 month offer, you must use your 1:1 session within those 3 months), whichever comes last, unless otherwise stated.

 

General

Ariana Jay reserves the right to cancel, postpone, or re-schedule services due to any unforeseen circumstances, inclusive of low enrollment. Should a cancellation occur, you will be offered a full refund or the option to transfer to another date, pending availability. I cannot compensate for any additional costs incurred in your efforts to attend a service.

I also have a zero tolerance policy for abuse, harassment, or any other personal violations of me, my staff, and any other people involved in these sessions, inclusive of people just like you who are participants. I reserve the right to immediately remove you from any session, without option for refund, if you participate in and/or instigate any of these actions.

This information is correct as of last date of edit, 7 October 2021, and these Terms remain subject to change. Ariana Jay reserves the right to change dates, location, venue, and content at my discretion, and to refuse to accept a booking.

 

WORKSHOP & TRAINING DISCLAIMERS

Friend, business is risky. And while I love using my experiences, and the experiences of countless other entrepreneurs I know, have worked with and have drank endless cups of coffee with, business is still risky. So my advice doesn’t come with any guarantees. If you think you need professional help, consider hiring a 1:1 business consultant or other professional.

 

Additionally, I’m an expert at what I do. I’ve got the credibility, experience, and skills. However, please remember that I am not a licensed psychologist or healthcare professional, and my services don’t replace the care of psychologists or other healthcare professionals. With that comes the standard eye-glaze inducing disclaimer that, no, I cannot actually guarantee the outcome of our coaching efforts and/or recommendations on my website/blog/email series/any other form of marketing, and my comments about the outcome are expressions of (my very personal) opinion only. I can guarantee you this, however: I will do my best to coach you, and I’ll do everything in my power to help you reach your goals.
